Migration Terms and Conditions

FXRK to Noctorial Account Migration Issued by Challenge Technologies FZCO

1. Eligibility and Offer Validity

This migration offer is available to all active FXRK account holders at the time of the announcement. The offer has no expiry date and remains valid until the trader either confirms or explicitly declines to proceed.

2. Nature of the Migration

The migration does not constitute a transfer of an existing account. Upon confirmation, the trader’s FXRK account will be permanently closed and a new, independent account will be created on the Noctorial platform. The new account will start with a clean equity curve, reset to zero. No trading history, profit and loss, open positions, or account balance will be carried over.

3. Funded Accounts — Reimbursement

Traders holding a funded FXRK account at the time of the announcement are not eligible for migration. Instead, Challenge Technologies FZCO will reimburse the challenge fee originally paid to obtain that funded account. Reimbursement will be processed within a maximum of 15 business days from the date the trader submits their reimbursement request. No further compensation, simulated profit, or account balance will be due or payable in connection with a funded account.

4. Capital Tier Upgrade

As a goodwill gesture, the new Noctorial account will be created at the next available capital tier above the trader’s current FXRK challenge level, at no additional cost. This upgrade is a one-time benefit granted solely in the context of this migration. It does not constitute a contractual entitlement and cannot be claimed in any other circumstance.

5. No Refunds and No Claims on FXRK Balances

By confirming the migration, the trader acknowledges that no refund, payout, or compensation in respect of their FXRK challenge account will be due or payable. Any simulated profit and loss accumulated on the FXRK account is forfeit upon closure and cannot be claimed in any form.

6. Governing Terms

From the moment the new Noctorial account is created, the trader’s relationship is governed exclusively by Noctorial’s own Terms and Conditions and Privacy Policy. FXRK rules, conditions, and policies do not apply to the new account in any respect.

7. Personal and Non-Transferable

This offer is made to the individual account holder only. It is strictly personal and non-transferable. The trader may not assign, sell, or otherwise transfer the benefit of this migration to any third party.

8. Data Transfer and Consent

By confirming the migration, the trader consents to Challenge Technologies FZCO sharing the following personal data with Noctorial for the purpose of creating the new account: full name, email address, and current challenge level. Data will be processed in accordance with Noctorial’s Privacy Policy, available at https://noctorial.com/en/privacy. Challenge Technologies FZCO will handle all data in compliance with applicable data protection legislation.

9. Confirmation Process

To proceed, the trader must provide explicit confirmation as requested in the migration email. Silence or inaction does not constitute acceptance. Challenge Technologies FZCO reserves the right to close the FXRK account at any time following the conclusion of the migration period regardless of whether the trader has confirmed.
